Introduction
These Terms of Service form a legally binding agreement between you, the customer, and Mombasa Pest Control, a professional pest management, mosquito net installation, and hygiene solutions provider operating in Kenya as a constituent of Rafiki Pest Control LTD and Bluelabs Hygiene LTD. By engaging with our services, purchasing our products, or accessing our website and associated platforms, you confirm that you have read, understood, and agreed to be bound by these Terms of Service. If you do not agree with any part of these Terms, you are advised not to proceed with the use of our services or products.
The purpose of this agreement is to establish the rights and obligations of both parties, to ensure clarity in the delivery of services, and to safeguard the interests of both the customer and the company. These Terms apply to all transactions, whether conducted in person, by phone, through written contract, or via our online platforms.
Scope of Services
Mombasa Pest Control provides a wide range of professional services, including but not limited to pest management, fumigation, rodent control, ant control, and the installation of magnetic mosquito nets, retractable screens, and related protective barriers. In addition, the company offers hygiene and cleaning services, all of which are carried out by trained professionals using approved methods and materials.
By requesting these services, the customer acknowledges that each service is tailored to the unique conditions of the property, the type of pest infestation, or the nature of the installation requested. As such, results may vary depending on environmental factors, structural characteristics of the property, and the degree of customer cooperation in implementing recommended aftercare measures.
Customer Obligations
Customers are expected to provide accurate and complete information when engaging Mombasa Pest Control. This includes property details, the nature of pest activity, prior treatments conducted, and any relevant health or safety concerns. Customers must also grant reasonable access to the property at agreed times and ensure that all preparatory steps communicated by our technicians are carried out prior to service delivery.
Failure to provide truthful information or to comply with pre-service instructions may compromise the effectiveness of the service and may relieve Mombasa Pest Control of liability for unsatisfactory outcomes. Customers are further expected to maintain a safe environment during service visits, including securing pets, valuables, and sensitive materials.
Pricing and Payment
All pricing for services and products is provided either through written quotations, published rate cards, or direct consultation with company representatives. Prices may vary depending on the size of the property, the level of infestation, the type of product required, or the complexity of installation.
Payment is due as per the agreed terms at the time of contracting, unless otherwise stated in writing. Mombasa Pest Control reserves the right to withhold or suspend services in cases of non-payment or late payment. Invoices not settled within the stipulated timeframe may attract penalties or interest charges as permitted by law.
Refunds and Service Guarantees
Mombasa Pest Control maintains a structured Refund Policy, which is separate from these Terms of Service and incorporated herein by reference. Customers should note that refunds are not automatic and are only considered after a proper assessment has been carried out to ascertain qualification. In many cases, alternative remedies such as re-treatment, replacement, or repair will be offered before a refund is considered.
By agreeing to these Terms, customers acknowledge that the company retains the sole discretion to determine whether a refund is appropriate, based on evidence, inspection, and compliance with service instructions.
Use of Products and Installations
When purchasing or receiving installation of mosquito nets, screens, or related protective barriers, customers agree to use and maintain these products responsibly. Misuse, tampering, or modification of the products after installation may void any warranties or guarantees. Mombasa Pest Control is not liable for damages caused by third-party interference, structural changes made after installation, or failure to follow care instructions provided by our technicians.
Intellectual Property
All content, designs, trademarks, trade names, and logos associated with Mombasa Pest Control, Rafiki Pest Control LTD, and Bluelabs Hygiene LTD remain the exclusive intellectual property of the company and its affiliates. Customers may not reproduce, distribute, or exploit any intellectual property without express written consent. Unauthorized use of company intellectual property may result in legal action.
Limitation of Liability
While Mombasa Pest Control employs industry best practices, uses approved materials, and trains its personnel to the highest standards, certain factors may limit the effectiveness of services. These include but are not limited to environmental conditions, customer non-compliance, and the presence of structural defects in properties.
The company’s liability is therefore limited to the cost of the service or product purchased. Under no circumstances shall Mombasa Pest Control, Rafiki Pest Control LTD, or Bluelabs Hygiene LTD be held liable for indirect, incidental, or consequential damages, including but not limited to property damage, loss of business, or health issues arising from pest infestations.
Termination of Services
Either party may terminate a service agreement by providing written notice, subject to any specific contractual terms in place. Mombasa Pest Control reserves the right to suspend or terminate services immediately if the customer engages in fraudulent activity, provides false information, fails to make payment, or engages in behavior that endangers company staff.
Upon termination, the customer remains responsible for payment of all outstanding balances for services rendered up to the date of termination.
Data Protection and Privacy
Mombasa Pest Control respects the privacy of its customers and complies with applicable data protection laws. Personal information collected in the course of service delivery is handled in accordance with our Privacy Policy, which outlines how we collect, store, and use data. Customers are encouraged to review this policy in detail to understand their rights and obligations regarding personal information.
Dispute Resolution
In the event of a dispute between Mombasa Pest Control and a customer, both parties agree to seek resolution first through direct dialogue and negotiation. If the matter cannot be resolved amicably, the parties may pursue mediation or arbitration prior to litigation. Any disputes that proceed to court shall be governed by the laws of Kenya and heard in a court of competent jurisdiction within the Republic of Kenya.
Amendments to the Terms
Mombasa Pest Control reserves the right to amend these Terms of Service at any time to reflect changes in law, company operations, or market conditions. Any such amendments will be published on our official platforms and will take effect immediately unless otherwise stated. Customers are encouraged to review these Terms periodically to remain informed. Continued use of our services following publication of amendments constitutes acceptance of the updated Terms.
